The Health Insurance Portability and Accountability Act (HIPAA) enacted in 1996 with the primary objective of providing protection to confidential information of patients. You would be surprised to know that there are thousands of intentional and unintentional violations of HIPAA that take place each year. There have also been instances of repeated violations by individuals and health care providers.

The confidential information should not be shared and viewed by anyone without the consent of the patient and there are some very strict guidelines that need to be followed for this purpose. There are specific instances when the information of patients can be shared with others and these are clearly mentioned in the Health Insurance Portability and Accountability Act and these should be followed.

If any individual or health care service provider as recognized by HIPAA does not follow these guidelines it would constitute a violation. There are various penalties that have been stipulated for HIPAA violation.

If medical information of a patient is discussed in public without their consent it would be a HIPAA violation. For instance if a health care service provider discusses the health history of a patient with his/her friends or relatives it would be a violation as per the Health Insurance Portability and Accountability Act. Similarly physicians should also not use any confidential information of patients as a medical brief without their consent.

If the medical record of an individual is accessed again and again without any proper reason or authorization, it could constitute a violation. There have been instances where the medical records of individuals are accessed by employees of health insurance companies numerous times without any specific reason and authorization.

Every health care provider who has access to confidential information would need to destroy all the old information of the patients in a systematic way and failure to do so is violation of HIPAA. The Health Insurance Portability and Accountability Act stipulate that medical records should be properly shredded and destroyed so that the confidential information cannot be misused.

You would be surprised to know that medical records of celebrities and politicians are among the most violated. Most magazines would be willing to pay a lot of money on any medical information of celebrities. Due to this the medical records of celebrities are among the most accessed.

Apart from this any decision pertaining to an employee (promotions and perks) are taken based on the medical records of the person that are confidential and accessed without authority, would be discrimination and would be a violation of the Health Insurance Portability and Accountability Act.

There are also time limits set on exclusion of existing medical conditions by HIPAA and this is usually 12 months. If the established time limits are exceeded by any insurance company it would be a violation. If you find that your confidential medical information has been violated in any way, you would be able to make a complaint to the Office of Civil Rights of health and human services department.

Car maker DeLorean dies at 80

Automobile industry pioneer, John DeLorean, died Saturday in a New Jersey hospital by complications from a stroke.

DeLorean was born in 1925 in Detroit, Michigan to European immigrant parents. He received an education in automotive engineering and quickly rose through the ranks of Packard and later General Motors (GM). DeLorean was credited with the development of the Pontiac GTO, which helped introduce the era of “muscle cars”. By 1965, DeLorean led the entire Pontiac division, and four years later was promoted to the prestigious position of leading GM’s Chevrolet.

In 1973, DeLorean quit General Motors and started his own company, the De Lorean Motor Company. The company’s product was the DMC-12, an unusual car featuring an unpainted, stainless-steel exterior and gull-wing doors. The company started production in 1981 but failed less than two years later, having produced under 9,000 vehicles. Despite the company’s failure and the car’s dismal sales, the car itself gained a cult following after the release of the 1985 movie Back to the Future which featured the car as a time-travel machine.

DeLorean himself was in nearly as much trouble as his company. In 1982 he was arrested for attempting to sell $24 million worth of cocaine to undercover police, and after his company’s failure, he became involved in a multitude of lawsuits alleging investor fraud. Though DeLorean successfully resolved the cocaine case after claiming entrapment, his other legal cases would drag on until 1999, when he declared bankruptcy.

Buffalo, New York —According to the developer Savarino Construction Services Corporation, the proposed Elmwood Village Hotel which would be placed on the corner of Elmwood and Forest Avenues in Buffalo, New York has been withdrawn from the city’s Planning Board and Common Council and will undergo a “do over”; however, Eva Hassett, Vice President of Savarino says that the proposal will be resubmitted, from scratch by the end of next week.

The hotel would require the demolition of at least five properties, 1109-1121 Elmwood and would cause the closure of several businesses. Already, two businesses, Skunk Tail Glass and Six Nations Native American Gift Shop have relocated, outside the Elmwood Strip. Don apparel, H.O.D. Tattoo and Mondo Video still remain on Elmwood; however, Mondo Video is planning on moving to a new location. The hotel will be 72 rooms and will cost at least 7 million dollars to build.

“We’re lovers, not fighters. Our energies should be spent on developing a really wonderful project, not wasted in court. We’ll start over with a clean slate and take as much time as necessary to hear people out and end up with a very positive project for the neighborhood,” said President of Savarino Construction, Sam Savarino.

The hotel will not undergo any major changes in its design says Savarino. “We would anticipate little if any physical change to the plans.” He also alleges that the issues with the hotel were not with the design or the proposal and also says that the hotel is still right for the intersection.

“The perceived problem was with the process, not the proposal itself. We believe this is the right thing to do on that corner,” added Savarino.

According to the Buffalo News, the projects resubmission is aimed to “shed the lawsuits” against the proposal. The Buffalo News also claims that the Common Council members are all still “in favor of the project.” The proposal was unanimously passed by the council on March 21, 2006.

Attorney Arthur J. Giacalone who represents the plaintiffs, Nancy Pollina and Patricia Morris, who operate Don Apparel (a vintage clothing and collectibles shop at 1119 Elmwood Avenue), Angeline Genovese and Evelyn Bencinich, owners of residences on Granger Place which abut the rear of the proposed site, Nina Freudenheim, a resident of nearby Penhurst Park, and Sandra Girage, the owner of a two-family residence on Forest Avenue less than a hundred feet from the proposed hotel’s sole entrance and exit driveway, says that the hotel proposal was “inappropriately rushed,” but some council members disagree. Defendants in the lawsuit against the hotel are, Buffalo’s Common Council and Planning Board, Mayor of Buffalo, Byron W. Brown, Savarino Construction Services Corporation, Hans J. Mobius and his son Hans S. Mobius owners of the properties at stake, Pano Georgiadis, owner of Pano’s Restaurant on Elmwood, and Cendant Corporation, the parent company of Wyndham Hotels, which will be, according to Savarino, the hotel operator. Attorney David State is representing the city, Planning Board, Mayor Byron Brown and the Common Council.

“I don’t think it was a rush job,” said Dominic J. Bonifacio Jr., the council’s Majority Leader.He also alleges that the only way to make “it [the hotel] a better project and ease the concerns of some neighbors would be to find a way to provide more parking.”

In an exclusive phone interview with Wikinews, Giacalone states that the lawsuit against the hotel and the city “will not be moved [withdrawn] unless the Common Council resins their [prior] decisions in passing the proposal.” Giacalone also says that Savarino has yet to submit any new plans for the proposal to the city. He also says that he “still plans to represent all plaintiffs” if they wish to continue with the suit and the use of his services.

Giacalone rescheduled the preliminary hearing which is “still in place” for July 27, 2006. When asked if the properties are still owned by Mobius, Giacalone replied “yes” and that according to attorney Bob Knoer, the Lawyer representing Hans Mobius, the owner of the properties that could be demolished, there is “no contract between Savarino” and that Mobius “plans to put the properties back on the market.” Mobius has not returned phone calls or e-mails and has not yet commented on the situation or the proposal itself. The city denies these claims.

In an exclusive phone interview by Wikinews, area councilman Joseph Golombek states that the reason for the resubmission of the proposal was due to “a mistake in the Planning process” and that none of the council members have “indicated that they have changed their opinions on the hotel” and still remain in favor of the project.

“I still think the Hotel is a good idea for that part of Elmwood. For Elmwood to stay strong and vibrant it must continue to grow and adapt to change. It is a different community than it was twenty years ago and will be different in another twenty years. The opponents of the Hotel have the opportunity to challenge it and are doing that. Even though I disagree with them I am glad there is a safety mechanism for people who disagree with government. We need to keep moving forward,” added Golombek.

Supporters of the hotel proposal are planning on holding a rally to support the new development. WNYmedia.net claims that the first rally will be held to support the hotel proposal on July 17, 2006 at 5:00 p.m. on Elmwood and Forest, on the site of the proposed location. According to WNYmedia.net they “are tired of the anti development crowd in Western New York.” They also blast opponents of the hotel proposal calling them “bananas” and “nimbys.” People opposed to the hotel proposal are planning on “counter attacking” with their own protest on the same day and time.

Guaranteed Issue Children Coverage For California Health Insurance

The various parts of Health Reform are scheduled to roll out at different times with some early parts already in place now before the big Jan 2014 roll out. One of the more significant pieces dealt with guaranteed issue health insurance for children up to age 18. This has largely been incorporated by the carriers into the market with slightly different approaches but let’s take a look at what to expect with children that have health issues.

Effective September 23rd, 2010, California health insurance for children age 0-18 is guaranteed issue. This means that a child cannot be declined coverage on the standard marketed individual and family health insurance plans due to pre-existing conditions or health. This is a pre-curser to what the rest of the market can expect Jan 1st, 2014 although the exchanges and resulting subsidies are not in place for this initial roll out of child only guaranteed issue coverage. This is the good news and for parents of children with serious health issues, a welcomed relief. It’s important to understand that although coverage cannot be declined to pre-existing conditions, the rates offered can be impacted significantly. Let’s take a look at how the carriers have addressed this rating factor.

We remember the 30 days prior to the Sept 23rd, 2010 roll out with mass updates from the carriers in a frenzied mode. It was clearly a work in progress to figure out the roll out of guaranteed issue as all parties attempted to understand the limits and requirements of the laws. Before we get into the rating factors, let’s look at “tiers” when discussing individual family health plan rates in California.

When you apply for health insurance in California, you generally go in with the quoted rates you find on our website. These are called “Tier 1” rates and are the best rates available on the market. These rates are based on good health and the actual offered rates can change after the underwriting process depending on your health. They generally go up along these lines: Tier 1 – best rates. Tier 2 is 25% higher than Tier 1. Tier 3 is generally 50% higher than Tier 1. Tier 4 might be 100% or more than Tier 1 depending on carrier. There can even be a Tier 5 which might be 200-300% higher than the Tier 1 best rate. These rating tiers have always been available even prior to the Sept 23rd roll out. There also a new 20% increase rating based on tobacco usage which can be accessed in addition to the other tier increases. Now, let’s discuss guaranteed issue coverage tiers for children which partially depends on when they apply.

If your child is applying during an open enrollment window such as during birth month or upon losing parent’s group health coverage, the amount applied may be capped at 100% of tier 1 rates. If applying outside of open enrollment window, the tiers can be very very high with rates between 200-400% depending on carrier and of course, health status/history. A 20% surcharge can be applied additionally for 12 months if the child did not have eligible prior coverage. Ultimately, a child may just qualify based on the original tiers (1-5) above so although the guaranteed issue rates can be high (especially outside of open enrollment), it’s good to have a fall-back option for children with more serious issues. Of course, the impact of this new option is that the rates for all children age 0-18 will go up and have over the past 12 months. We would expect the same thing to happen Jan 2014 when guaranteed issue is rolled out to all individuals as the rates start to catch up with group health insurance rates which have been guaranteed issue for over a decade now. Porsche and Volkswagen automakers agree to merger

Porsche and Volkswagen family owners agreed on Wednesday to merge the companies, creating one large “integrated car-manufacturing group”.

“In the final structure, 10 brands shall stand below an integrative leading company alongside each other, whereby the independence of all brands and explicitly also of Porsche shall be ensured,” said the Porsche Automobil Holding SE company.

A task force has been set into place to discuss details of the merger over the next month. This task force embraces managers and representatives from the works council of both companies as well as the state of Lower Saxony.

Porsche based in Stuttgart, Germany was previously controlled by the Porsche and Piëch families voting stock.

Porsche had previously tried to raise its 51% shares in Volkswagen to 75% in a take-over bid. A special German law grants Lower Saxony enough power to veto decisions with its 20% share in the VW company.

“I’m certain that we can and will advance our partnership in the difficult current year 2009, [and] have the stuff to develop the powerhouse of the international automobile industry” said Martin Winterkorn chairman of the Volkswagen Group (Volkswagen AG) and Scania AB.

The merger would help Porsche with its €9 billion debt which it incurred partially due to the ailing economy as well as its attempt at a takeover bid.

Swine flu outbreaks appear globally; WHO raises pandemic alert level to 5

New cases of the swine flu virus have been reported around the world in recent days, prompting fear of a global influenza pandemic. As a result, the World Health Organization (WHO) raised the pandemic alert level to 5. The United Nations has warned that the disease can not be contained. At least 91 confirmed cases of the flu have been reported worldwide.

In a special report, Wikinews takes a look at the reaction to the outbreak, and how different countries around the world have been affected by it.

The disease, which is believed to have originated in Mexico, has now spread across the globe, with confirmed cases having been reported in Canada, the United Kingdom, Spain, New Zealand, Costa Rica and Israel. The United States has also reported its first death from the disease in a toddler. South Korea and France both had probable cases.

The WHO said on Tuesday that while it was not yet certain that the outbreak would turn into pandemic, countries should prepare for the worst. “Countries should take the opportunity to prepare for a pandemic,” said the acting assistant director-general for the WHO, Keiji Fukuda.

“Based on assessment of all available information, and following several expert consultations, I have decided to raise the current level of influenza pandemic alert from phase 4 to phase 5,” said Margaret Chan, the Director-General of the WHO, in a statement on Wednesday. “…All countries should immediately activate their pandemic preparedness plans. Countries should remain on high alert for unusual outbreaks of influenza-like illness and severe pneumonia.” After the announcement was made, Wikinews learned that the WHO website had crashed for several minutes, presumably due to high traffic volume.

There is no vaccine for swine flu. In 1976 during an outbreak of the virus, at least 500 people became seriously ill, and of them, 25 had died when inoculated with an attempt at a vaccination. The 500 that became ill developed a neurological disorder called Guillain-Barré syndrome (GBS) which caused paralysis “and is characterized by various degrees of weakness, sensory abnormalities and autonomic dysfunction.” Those who developed the disorder did so because of an immunopathological reaction to the drug. Nearly 40 million US residents, including then US president Gerald Ford, were inoculated.


Screening measures at Canadian airports have been raised on Tuesday to screen passengers returning from Mexico for symptoms of swine flu. The measures come amid reports that thirteen people have now been infected in the country, in four different provinces.

The Public Health Agency has recommended Canadians who have booked flights to Mexico to delay them if possible. Those who choose to fly anyway will be asked questions about their health after they return, such as whether they have had symptoms of the flu, like diarrhea, coughing, or a sore throat. If anyone answers in the affirmative, they may be further assessed and perhaps transferred to a quarantine officer, who will suggest that they seek medical help, or isolate themselves at home.

“These measures will help to prevent further spread and protect the health of Canadians and we thank you for your patience and co-operation with this process,” said the chief public health officer, David Butler-Jones.

Several Canadian airlines have also limited or cancelled flights to Mexico. Air Transat and its partner tour companies, Nolitours and Transat Holidays, have cancelled all flights bound to Mexico until June 1. West Jet has also stated that it will suspend all vacation planning and air flights for Cancun, Mazatlan, Cabo San Lucas, and other destinations in Mexico.

Egypt, which has not yet reported any cases of the flu, has recently begun a campaign to slaughter all 300,000 pigs in the country, despite assurances by health officials that the disease is not transmitted from animals to humans. “It has been decided to immediately start slaughtering all the pigs in Egypt using the full capacity of the country’s slaughterhouses,” Egypt’s health minister, Hatem el-Gabaly, told reporters.

Farmers have been protesting the measure. At one pig farming area in the country, crowds of farmers blockaded the roads to prevent health officials from entering to slaughter their pigs. Some of the farmers hurled stones at officials’ vehicles, and the latter was forced to retreat without killing any of the animals.

In Mexico, the epicentre of the outbreak, officials have announced up to 159 suspected deaths from the virus, out of a total of 2,498 suspected cases. The Mexican cabinet has announced that all flights departing from Mexico City will be suspended, while Argentina and Cuba have both cancelled all flights to the country. The European Union and the US have both issued warnings against traveling to Mexico.

The Royal Caribbean cruise line has suspended all stops in Mexico indefinitely, while Norwegian Cruise Line announced that its vessels will not make stops at Mexican ports until September of this year.

The government has ordered all restaurants in the country’s capital to serve only carry-out food, and closed archaeological sites with the intent of limiting large groupings of people. Churches, gyms, pool halls, and other institutions in Mexico City have been asked to close. School classes across the country have been suspended until May 6.

The Mexican government has estimated that the epidemic is costing companies in the capital at least US$57 million per day, and that tourism revenue has dropped by 36%. The finance ministry has set up a special fund of $450 million to fight the disease.

Thirteen confirmed cases have been known in New Zealand. All of them have been prescribed the antiviral drug Tamiflu.

New Zealand airports have now started to screen at least ten thousand people who arrive in the country from flights from Northern America. Those who display symptoms of the flu are taken aside by health authorities and placed into a quarantine.

“The number of suspected cases is likely in increase,” said Fran McGrath, the Deputy Director of Public Health. “While the numbers in any category will fluctuate, this is a pattern to be expected from an influenza outbreak. It is important to note that the 13 people we are treating as confirmed cases have all had mild flu symptoms, have received treatment and are all on the mend of have recovered.”

Spain’s health minister Trinidad Jinenez announced on Wednesday that a total of 53 persons in the country are under observation for the influenza. The number of confirmed cases in the country has been risen from four to ten, including one person who did not obtain the illness by traveling to Mexico.

Until now, Jimenez said that all of Spain’s confirmed cases involved persons who had recently visited Mexico, where the outbreak is believed to have began.

British Prime Minister Gordon Brown announced that five people who recently visited Mexico are now ill with the swine flu in the United Kingdom. “All of them have traveled recently from Mexico,” he said. “All of them have mild symptoms. All of them are receiving and responding well to treatment.”

The school of one the infected people, a twelve-year-old girl from Torbay, has been shut down and its 230 pupils given the drug Tamiflu, Brown said.

The Prime Minister said that the country is preparing for a possible pandemic. It has increased its stocks of antiviral drugs, enough for fifty million people, and ordered additional face masks for health workers. The government has encouraged all British residents to avoid travel to Mexico.

A 23-month-old boy from Mexico died at a Houston, Texas hospital on Wednesday, the first casualty from swine flu in the United States. The child had arrived in Brownsville, Texas, near the border with Mexico, with unspecified “underlying health issues” on April 4. Several days later, he presented symptoms of swine flu, and was hospitalized on April 13. The next day, the boy was transferred to a Houston hospital, where he remained until dying on Monday night of pneumonia brought on by the virus.

In response to the epidemic, Texas governor Rick Perry has given a disaster declaration. Schools have closed down statewide. Californian governor Arnold Schwarzenegger has also declared a state of emergency in his state.

The Centers for Disease Control and Prevention (CDC) updated the number of incidents of swine flu in the country to 64 on Tuesday.

President Barack Obama has asked Congress for a fund of $1.5 billion to fight the outbreak, saying that it is needed for “maximum flexibility to allow us to address this emerging situation.”

US health authorities have warned that more cases and fatalities from the flu are probable. “We expect to see more cases, more hospitalizations, and, unfortunately, we are likely to see more deaths from the outbreak,” said Kathleen Sebelius, the Health and Human Services secretary.

Sadr City suicide bomber uses fruit truck to kill 66 on market day

A suicide bomber exploded a truck bomb in the crowded Al-Ula market in Sadr City in Baghdad on Saturday, killing 66 people and injuring over a 100.

‘At the beginning of this market, the criminal blew up his dynamite-packed truck after trying to go over the pavement,’ said Iraq’s Deputy Health Minister Sabah al-Hussein.

The explosion happened when a police patrol was passing by and caused heavy casualties in the morning market rush. Some shoppers were sent flying on top of nearby two-storey buildings.

The force of the blast left a large crater and wreckage of blown-out cars and windowless buildings. Rescuers were left to pick through a sickening scene of human remains mixed in with exploded vegetable matter and dead animals.

Sadr City, a Shiite city of two million in which religious leader Moqtada Sadr has found popular support, had many times before been targeted by Sunni terrorists who were blamed by some residents for this attack.

It was the deadliest bombing of civilians since Prime Minister Nouri al-Maliki‘s government assumed responsibility for domestic security in May 2006.

Experts said the truck bomb was a lethal concoction of explosives, shells and shrapnel hidden under a consignment of fruit. The driver of the truck blew himself up in the explosion.

When planning a trip hiking in Costa Rica, smouldering volcanoes and wild rainforests are often some of the first images that spring to mind. The whole country is a natural paradise, with many fantastic sights to behold. Here a just a few of the highlights:

Cahuita

Cahuita is one of the few places in the world where you can combine a trek through a verdant jungle with an afternoon sunbathing on a perfect white sand beach. The region also contains a national park, which is among one of the most visited in the whole country. This park was formed in 1970 to protect Costa Rica s largest coral reef and is a popular place to try your hand at scuba, snorkelling and deep-sea diving. The park even contains an 18th century shipwreck, which is fascinating to explore.

The crystal clear waters make the area ideal for swimming and spotting different species of marine life from sea urchins to angel and parrot fish. You may also be lucky enough to spot a Carey Turtle or lucky (or unlucky) enough to spot one of the three species of sharks that frequent the area. The animal species found in the jungle include sloth, possums and monkeys, with birdlife including kingfishers, heron and ibises amongst others.

11-year-old California girl charged for throwing stone in defense

An 11-year-old girl faces serious assault charges in California after casting a stone at a group of boys who were throwing water balloons at her. In April, Maribel Cuevas was apprehended by Fresno, California police and spent five days in a detention center after throwing the object at the group of boys who bombarded her with water balloons as she walked down the sidewalk. A 9-year-old boy was hit with the stone, and suffered a wound to his head requiring medical assistance.

Since then, Cuevas has spent one month under house arrest pending court. Cuevas’ lawyer, Richard Beshwate, told the BBC that “They [Fresno police] are treating her like a violent parole offender. It’s not a felony, it’s an 11-year-old acting like an 11-year-old.”

Fresno Police Sergeant Anthony Martinez told reporters: “We responded. We determined a felony assault had taken place and the officers took the actions that were necessary.” Cuevas is due back in court next month on felony assault charges.

The girl was placed in juvenile hall during her five-day detention, with only one 30-minute visit from her parents. She was then placed under a 30 day house arrest and required to wear an electronic monitoring bracelet. The house arrest allowed the girl to attend school.

Maribel, who knows very little English, said that the boy initiated the conflict — the boy also admitted as much.
